This Privacy Policy (the “Policy”) applies to the website located at www.sffilm.org (together with its microsites and subdomains and all affiliated mobile applications, collectively the “Site”), operated by San Francisco Film Society d/b/a SFFILM (together, “SFFILM,” “we” or “us”). This Policy describes whether and how we collect and use information about you when you visit the Site. Your visit to the Site is subject to this Policy and our Terms of Use. By visiting and using this Site, you agree to this Policy, which may be updated by us from time to time. We will post any updates to this Policy here, which will be effective upon posting. You should consult the “Privacy” link on the Site each time you visit the Site. If you do not agree with this Policy, you should not use the Site.
1. Information We Collect
When you enter and browse the Site, we may collect information that you provide to us and/or that you authorize Third Party Services (as defined below) to share with SFFILM. We also may collect information regarding you through technology, as described in Section 2. In order to access certain content, you may be required to provide information that allows us to identify you personally, including your name, email address and other information, or authorize SFFILM to collect certain personal information from San Simeon Films, LLC, BoxCubed, Agile Ticketing Solutions, Eventbrite, iTunes, Google Play, or other third party services (“Third Party Services”) subject to such Third Party Service’s privacy policies and terms of use. We refer to such information as personally identifiable information.
2. Cookies; Tracking Mechanisms
We may also collect information about you through technology. Cookies are small text files that may be placed on your browser when you visit our Site. Cookies are used primarily for administrative purposes to improve your experience with our Site. For instance, when you return to the Site after logging in, cookies provide information to the Site, including personal information, so that the Site will remember who you are. SFFILM may use cookies to pre-populate or auto-populate forms, for example. These cookies help SFFILM improve functionality of the Site and provide a seamless experience for users.
The information in a cookie includes a user’s IP address and is transmitted to and stored by third party services providers, such as Google. (An IP address is often associated with the portal through which you enter the Internet.) Cookies may also be used to capture anonymous analytics to improve your experience with the Site and its performance. This includes compiling statistical information concerning, among other things, the frequency of use of our Site, the pages visited, the length of each visit, and which webpages you visit after the Site, as well as information about your computer, operating system, browser, language, and country. You may at any time delete or prevent the transmission of any cookies by using the relevant option of your Internet or mobile browser or by deleting the cookies on your hard drive or mobile device. Using the settings of your Internet or mobile browser, you can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. If you choose to turn off cookies, you may not have access to many features that make browsing our Site simpler, and some of our services may not function properly. SFFILM may also use web beacons. Web beacons communicate with a server when the contents of a webpage are retrieved, and enable us to track the number and timing of visitors to certain sections of the Site. We may employ web beacons to help us compile aggregated statistics regarding the operations of the Site. We prohibit web beacons on our Site from being used by third parties to collect or access your personal information.
3. How We Use and Share Your Information
The information we collect about you is used to enhance your experience when using the Site and to display personalized content and possibly advertising. We do not share personally identifiable information with third-party organizations for their marketing or promotional use (i) unless we obtain your prior consent, or (ii) except as part of specific programs or features for which you will have the ability to opt out. By way of example, and without limitation, one such program may include sharing your information with other San Francisco Bay Area cultural organizations through list exchanges designed to pair patrons with organizations whose work might interest them. If you would like to opt out of these specific programs or features, please contact us at the email address listed in Section 13 below. SFFILM does not otherwise disclose your information to any third parties, except as set forth below.
We may use or disclose certain personally identifiable information we collect about you as part of our normal business operations, e.g. to facilitate your activation and maintenance of a membership with SFFILM. We may also use or disclose your personally identifiable information to send you administrative communications about your interactions with us or features of the Site, including any future changes to this Policy, as well as other marketing emails you have subscribed to (subject to your right to opt out of communications at any time by following the instructions in the email you receive). We may also share your personally identifiable information among our affiliates. We may also use service providers for the Site. They may have access to your personally identifiable information as needed to perform their functions, but may not use it for any other purpose. We may also share your personally identifiable information with Third Party Services as needed.
We will also use or disclose personally identifiable information when we believe that such disclosures are (i) required by law or requested by governmental or law enforcement authorities pursuant to subpoena, court order, document request or other legal process, or (ii) when we otherwise believe in good faith that such disclosure is appropriate to enforce this Policy or our Terms of Use, or in connection with any activity that may violate the law or the rights of others, threaten the safety or security of any person or property (including the Site), or expose SFFILM to liability. Also, if SFFILM or any of its assets or businesses are acquired or merged with or into another entity, user information (including personally identifiable information) may be one of the transferred assets.
4. Protection of Information
We use reasonable methods to protect the security of your personally identifiable information. Please be aware that there is no such thing as “perfect security” on the Internet, and third parties may unlawfully intercept or access transmissions to and from the Site or otherwise access your information, and your information may be disclosed. In no event shall SFFILM and its employees, agents, directors and investors be liable to any party for any claims, liabilities, losses, costs and damages under any theory, relating to any unauthorized access to or use of any personally identifiable information submitted by you to this Site or otherwise collected by the Site.
5. Other Websites and Third Party Services
This Policy applies only to the Site. If you visit any unaffiliated website linked to the Site (for example, Facebook, Twitter or other social media websites), you are subject to that website’s own privacy policies, which we do not control or monitor. You should review the privacy policies of all third party websites before you visit them. SFFILM makes no representations or warranties as to the privacy practices, functioning or content of any websites linked to this Site.
The goods and services of third parties may be advertised and/or may be made available on or through the Site. Your use of any products and services provided by third parties will be governed by the policies and representations made by those third parties. SFFILM will not in any manner be liable for or responsible for any of your dealings or interaction with third parties.
6. International Use
This Site is intended for use by individuals in the United States. Despite the global nature of the Internet, SFFILM makes no claims that the Site is appropriate or may be viewed or used outside the United States. Furthermore, our databases are located in the United States, and your data is stored in the United States. This Site is intended for use by individuals in the United States. By sending us your information, you consent to its transfer to and storage within the United States and its use in a manner consistent with this Policy.
7. Children’s Privacy
The Site is not targeted toward, and we do not seek or desire to collect information from, children under the age of 13. Therefore, we will not knowingly request information from persons under such age. Please do not provide any personally identifiable information to us for any reason unless you are at least 13 years of age, and please caution your children not to do so if you are a parent of children under the age of 13. A parent or guardian may inform us that we have collected personally identifiable information of a child under the age of 13 at info@sffilm.org. Consistent with the Children’s Online Privacy Protection Act, if we become aware that we have collected any personally identifiable information from children under 13, we will use commercially reasonable efforts to delete such information from our databases, subject to applicable law and this Policy.
8. California “Do Not Track”
Some websites keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. As described in Section 2, SFFILM may use cookies and third party services such as Google Analytics and Facebook Custom Analytics to improve the Site. If you would like to avoid these cookies, certain web browsers allow you to set the Do Not Track (“DNT”) signal on your browser so that third parties (particularly advertisers) know that you do not want to be tracked. You should consult your web browser’s “help” feature for instructions on how to set the DNT signal.
Third parties that have content embedded on the Site such as a social feature or a stock ticker may set cookies on a user’s browser and/or obtain information about the fact that a web browser visited the Site from a certain IP address. SFFILM does not control or monitor such practices. You should contact such third parties directly to opt out.
9. California’s Shine the Light Law
California Civil Code Section 1798.83, known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. 10. Disclaimers and Limitation of Liability
SFFILM, its affiliates and their respective officers, directors, managers, partners, members, shareholders, employees, affiliates and agents (collectively “Related Persons”) make no representations or warranties and specifically disclaim any and all warranties of any kind, express or implied, with respect to the Site, including any representations or warranties with respect to merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, freedom from viruses or malware, completeness, timeliness, functionality, reliability, sequencing or speed of delivery. SFFILM does not warrant that the information in this Site is accurate, reliable, complete or correct, or that this Site will be available at any particular time or location. Your use of the Site and the Content is on an “as is” and “as available” basis.
In no event shall SFFILM, its affiliates or their Related Persons be liable to any party for any claims, liabilities, losses, costs or damages under any theory, relating to your access to or use of (or inability to use) the Site or any content therein. This is true even if SFFILM, its affiliates or their Related Persons have been advised of the possibility of such damages or losses.
11. Retention of Data
SFFILM may retain aggregate and de-identified data indefinitely. We maintain your personal data, Screening Room profile information and other information so long as you have not cancelled your account through the provided mechanism on the Site. We may maintain certain information after you cancel your account for reasonable purposes, such as to complete pending or outstanding payments or in accordance with our retention policies.
12. Governing Law/Venue
The laws of the State of California govern this Policy and your use of this Site in all respects. Any dispute relating to this Policy and your use of this Site shall be resolved solely in the state or federal courts located in San Francisco, California. You consent and submit to the personal jurisdiction of such courts for the purposes of any such dispute, controversy or claim, and agree to waive trial by jury in any such dispute. If any provision of this Privacy Policy is held to be unenforceable, such provision will be reformed only to the extent necessary to make it enforceable and all other terms of this Policy shall remain in full force and effect.
